End-User License Agreement
Last updated: October 28, 2026
This Agreement governs use of the internal reporting application (“the Application”) made available by Strength and Performance Training, Inc. (“SAPT”).
1. Internal use only
The Application is proprietary software built for SAPT’s own business operations. It is not distributed, sold, or licensed to the public. Authorized users are SAPT employees and contractors who have been granted access by SAPT.
2. License
SAPT grants authorized users a limited, non-exclusive, non-transferable, revocable license to use the Application solely to perform their duties for SAPT. All rights not expressly granted are reserved.
3. Restrictions
Authorized users may not copy, modify, distribute, sell, lease, or sublicense the Application; reverse engineer or attempt to derive its source code except as permitted by law; share access credentials with any other person; or use the Application for any purpose other than SAPT’s business operations.
4. Data
The Application reads business data from SAPT’s own accounts with third-party services, including its accounting, payment, customer relationship, and advertising platforms. All such data remains the property of SAPT. Use of those third-party services is governed by their own terms.
5. Confidentiality
Information accessed through the Application is confidential business information of SAPT. Authorized users must not disclose it to anyone outside SAPT without written authorization.
6. Termination
SAPT may revoke access at any time and for any reason. Access ends automatically when a user’s employment or engagement with SAPT ends. On termination, the user must stop using the Application and destroy any copies of data obtained through it.
7. No warranty
The Application is provided “as is,” without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. SAPT does not warrant that the Application will be uninterrupted or error-free, or that the information it displays will be accurate or complete.
8. Limitation of liability
To the fullest extent permitted by law, SAPT will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to use of the Application.
9. Governing law
This Agreement is governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
